Compare stores, offices and warehouses in Guadalajara and Zapopan: zoning, licenses, leases, VAT and market data before signing.

Before you sign for a storefront, an office or a warehouse in Guadalajara or Zapopan, check five things: that zoning (uso de suelo) allows your type of business at that exact address, that you can get the municipal business license (licencia de giro), what the maintenance or condo fees are, what the commercial lease says, and how VAT (IVA) applies. Commercial rent is subject to VAT, and when you buy, the building is subject to VAT while the land is not.

A useful space should support daily operations: customer access, staff comfort and manageable running costs. Tour it with a concrete checklist as well as comparing the facade and rent.

Zoning comes first

Guadalajara and Zapopan are separate municipalities with their own urban plans, so two units on the same avenue can follow different rules.

  • Guadalajara: the city's Visor Urbano shows the zoning of a parcel using its property tax account number. The formal certificate for a business license is the Dictamen de Usos y Destinos Específicos; the official city listing, checked on October 29, 2026, shows a fee that should be confirmed against the current revenue law before applying.
  • Zapopan: the city issues an informational zoning certificate (constancia de uso de suelo) and a formal zoning ruling (Dictamen de Trazo, Usos y Destinos Específicos). The official Zapopan procedures registry lists MXN 1,495 plus a MXN 309 form fee and up to 5 business days for the ruling, based on Zapopan's 2026 revenue law.

Our advice: get the zoning answer before you sign. If the landlord will not wait, add a clause that lets you walk away without penalty if zoning comes back negative.

The business license

Request the requirements for your own activity and exact address. The previous tenant's license is a useful starting point, not proof that your operation will be approved. Guadalajara publishes procedures by business category; Zapopan provides its RETyS registry and digital service desk.

Build inspection time and fit-out work into your opening plan. An administrative deadline for a complete application does not include every step needed to open a business.

Parking and civil protection

  • Parking: Guadalajara has a specific review of parking spaces for business licenses, with an inspection by the mobility department. If the unit lacks the spaces your business requires, solve that before signing.
  • Civil protection: in Zapopan, medium-impact businesses need a civil protection approval, requested through the city procedures registry. In Guadalajara, the risk management inspection is part of the Type B license.

Maintenance and condo fees

Shopping plazas, office towers and industrial parks usually charge maintenance on top of rent. CBRE notes that its asking rents exclude maintenance and taxes. Ask for the current fee and what it covers, the building or plaza rules (hours, signage, banned uses, allowed works) and, if you buy, a letter confirming no unpaid fees.

Commercial leases in Jalisco

The Jalisco Civil Code has a specific section for commercial and industrial property. The official state-code text checked on October 29, 2026 provides:

  • Leases can run up to 20 years for commerce and 25 for industry; leases longer than 8 years must be recorded at the Public Property Registry.
  • Rent is freely agreed, as a fixed amount or a percentage of gross income.
  • Assigning the lease is only allowed if the contract says so, and the original tenant stays jointly liable.
  • A tenant in good standing is entitled to an extension equal to one quarter of the original term.

The law does not set a security deposit amount; negotiate it and write down what it covers and when it is returned.

VAT and withholding

  • Rent: Mexico's VAT law only exempts rent of property used exclusively as a home (article 20). Commercial rent is subject to the general 16% rate (article 1).
  • Withholding: when the tenant is a Mexican company and the landlord is an individual, the company must withhold part of the income tax and VAT. Ask a Mexican accountant which rates apply to you.
  • Purchase: article 9 exempts the sale of land and of homes. For a commercial building, VAT applies to the construction value but not to the land, so the deed and appraisal should separate both values. Your notary and accountant will define how.

Transfer tax when you buy

Ask for a closing estimate separating the municipal transfer tax, registry charges and professional fees. Do not apply a headline rate to the entire price: Zapopan's 2026 schedule uses a fixed amount plus a marginal rate on the excess within a bracket.

Illustrative example: article 49 gives approximately MXN 149,200 for a MXN 5,000,000 tax base: MXN 85,200 plus 3.2% of the excess over MXN 3,000,000.01. This excludes other closing costs and is not a Guadalajara quotation.

A note for foreign buyers

Guadalajara and Zapopan are outside Mexico's restricted coastal and border zone, so a bank trust is not the default route there. Your notary will confirm whether you buy as an individual or through a Mexican company and which filing with the Foreign Affairs Ministry applies.

Area differences, with published data only

For street retail, compare frontage, signage, pedestrian access, parking and the same immediate location. Office and industrial market reports describe different products; they do not price a small storefront.

  • Offices: Solili's market report (updated September 2026) puts the average asking rent in Guadalajara at USD 20.05 per m² per month, with Providencia at 22.52, Puerta de Hierro (the Andares area) at 21.67, López Mateos Sur at 19.07 and Vallarta-Américas at 17.89. CBRE reported 11.3% vacancy for Class A/A+ offices in 2Q 2026, with 28.3% in López Mateos–Américas and 6.9% in Puerta de Hierro.
  • Warehouses: CBRE reported 6.04 million m² of Class A industrial space in 3Q 2026, 48% of it in El Salto, with vacancy down from 6.0% to 4.8%. These figures cover CBRE’s Class A industrial inventory, not every small warehouse. Inspect loading access, power capacity, floor specifications and clear height for the space you are considering.

Buy or lease?

Lease if you are still testing a location or your capital works harder in your business. Buy if you plan to stay for many years, want to adapt the space, or want an asset to rent out.
